Terms of Service

1. Agreement to Terms

By accessing or using SwiftSherpas ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

SwiftSherpas is an educational program and mentorship community focused on teaching participants how to design, build, ship, and maintain real iOS applications for the App Store.

The Service provides:

• Access to educational sessions and materials
• Mentorship from experienced engineers
• Participation in collaborative app development projects
• Community access and peer learning opportunities

3. Not an Investment

Any membership fees paid are for access to educational services and community resources, not for financial participation in any project or revenue stream.

4. Contributor Compensation

Some projects may optionally offer contractual royalties or bonuses to contributors for shipped deliverables. Such compensation:

• Is governed by a separate Contributor Agreement for each project
• Is available only for verified, shipped contributions accepted into a release
• Cannot be purchased. It is earned through contribution only
• Is not guaranteed and depends on the app generating revenue
• Requires tax and payment onboarding (W-9/1099 where applicable)

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

• Provide accurate and complete registration information
• Notify us immediately of any unauthorized use
• Not share your account with others

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Harass, abuse, or harm other users
• Submit malicious code or attempt to compromise the Service
• Misrepresent your contributions or qualifications
• Violate any applicable laws or regulations

7. Intellectual Property

The publishing entity for each project owns all intellectual property rights in the applications developed. Contributors license their work in exchange for potential compensation and credit as specified in the applicable Contributor Agreement.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT ANY APP WILL BE PROFITABLE OR GENERATE REVENUE. WE DO NOT GUARANTEE EMPLOYMENT OR ANY SPECIFIC OUTCOME FROM PARTICIPATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIFTSHERPAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

10. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
